Terms of Service

1. Acceptance of Terms

By accessing this website, submitting an inquiry, or receiving services from Leading Pathways ABA, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services. These Terms apply in addition to any separate service agreement, intake paperwork, or consent forms you sign directly with us, which will control in the event of a conflict.

2. Description of Services

Leading Pathways ABA provides Applied Behavior Analysis (ABA) therapy and related services to children and families in South Florida. Our website provides general information about our services and allows visitors to request consultations; it is not a substitute for a clinical evaluation, individualized treatment plan, or professional medical/behavioral health advice.

3. Eligibility & Enrollment

Services are provided to clients following an intake process, clinical assessment, and (where applicable) insurance authorization. Enrollment in services is subject to clinical appropriateness, staff availability, and completion of required consents and paperwork. We reserve the right to decline or discontinue services where continued treatment is not clinically appropriate or where these Terms are violated.

4. Appointments & Scheduling

Appointments are scheduled in coordination with your assigned BCBA, RBT, or care team. We will make reasonable efforts to notify you of scheduling changes, and we ask that you do the same. Appointment reminders and updates may be sent by phone, email, or SMS text message, consistent with the Mobile Information & SMS Messaging section of our Privacy Policy above.

5. Cancellations, Rescheduling & No-Shows

We ask that you provide as much advance notice as possible if you need to cancel or reschedule a session — [insert your required notice window, e.g., “at least 24 hours”]. Repeated late cancellations or no-shows may:

  • Affect continuity and progress of your child’s treatment plan
  • Be subject to a cancellation/no-show fee of [insert amount, if applicable]
  • Result in review of continued scheduling availability

Some insurance plans have their own attendance and authorization requirements; excessive absences may also affect insurance authorization for continued services.

6. Billing, Insurance & Payment

Services may be billed directly to your insurance provider, subject to your plan’s coverage, authorization, copay, and deductible terms. You are responsible for:

  • Providing accurate and current insurance and billing information
  • Any copays, coinsurance, deductibles, or non-covered charges under your plan
  • Notifying us promptly of any change in insurance coverage

We are not responsible for coverage denials, lapses, or changes made by your insurance carrier. Outstanding balances may be subject to our standard billing and collections procedures.

7. No Emergency Services

Leading Pathways ABA does not provide emergency or crisis intervention services. If you or your child is experiencing a medical or psychiatric emergency, call 911 or go to the nearest emergency room. Communications sent through our website, email, or SMS text program are not monitored continuously and should not be used to report an emergency.

8. Client & Family Conduct

We ask that clients, parents, and guardians engage respectfully with our staff and follow reasonable safety guidelines during in-home, in-clinic, or telehealth sessions. We reserve the right to suspend or discontinue services in cases of threatening, abusive, or unsafe conduct toward our staff.

9. Website Use & Intellectual Property

All content on this website — including text, graphics, logos, and images — is the property of Leading Pathways ABA or its licensors and is protected by applicable intellectual property laws. You may view and share content for personal, non-commercial purposes, but may not reproduce, modify, or distribute it without our prior written consent.

10. Third-Party Links

Our website may link to third-party sites (such as insurance providers or social media). We are not responsible for the content, accuracy, or privacy practices of those third-party sites.

11. Disclaimers

Our website and general informational content are provided “as is,” without warranties of any kind. Nothing on this website constitutes a guarantee of specific treatment outcomes. Individual results vary based on each client’s needs and circumstances.

12. Limitation of Liability

To the fullest extent permitted by law, Leading Pathways ABA shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or reliance on general information provided here. This limitation does not apply to liability arising from the direct clinical services you receive, which are governed separately by your signed service agreement and applicable professional standards of care.

13. Indemnification

You agree to indemnify and hold harmless Leading Pathways ABA, its staff, and affiliates from any claims, damages, or expenses arising from your misuse of this website or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Palm Beach County, Florida.

15. Changes to These Terms

We may update these Terms of Service from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
